1 - APPLICATION

The following general terms and conditions of use and sale (hereinafter referred to as the "General Conditions") govern the contractual relationships between any user of the website http://www.ma-belle-equipe.fr (hereinafter referred to as the "Site") wishing to make a purchase from Ma Belle Equipe through the Site (hereinafter referred to as the "Client") and the company Millenium, a limited liability company (SARL) with a capital of €1,000. The company Millenium is registered with the Roubaix-Tourcoing Trade and Companies Register under the SIRET number 82440103800016.

Ma Belle Equipe’s main activity is the sale of goods on the site. As such, Ma Belle Equipe is subject to the applicable French laws, particularly the "Informatique et Libertés" law and the "Pour la Confiance en l’Economie Numérique" law, in its capacity as a distance seller via the Internet.

The detailed general sales conditions set forth below apply to all orders placed with MILLENIUM SARL for all items and services offered on the site ma-belle-equipe.fr, unless otherwise stated in a prior written agreement. These general terms and conditions of sale are systematically presented to you at the time of placing an order.

All commercial transactions carried out by our Company are subject to these general terms and conditions of sale, which govern the contractual relationships between any user of the site www.ma-belle-equipe.fr wishing to make a purchase via the site ma-belle-equipe.fr and the company Millenium SARL, registered with the Roubaix-Tourcoing Trade and Companies Register under the SIRET number 82440103800016 (hereinafter referred to as "Ma Belle Equipe").

At any time, Ma Belle Equipe may modify certain provisions of these General Sales Conditions. Consequently, it is necessary to be aware of the version in effect on the day of the order on the Site. These modifications are enforceable from their posting online and will apply to orders placed after their posting on the Site.

 

2. DEFINITIONS

To facilitate the understanding of the General Conditions, the following terms are defined

Territory: Refers to France and Belgium

Users: Refers to any person located in the Territory who connects to the Site

Classic Sale: Refers to the ongoing sale of a product in the catalog.

Pre-Sale, Flash Sale, or Event Sale: Refers to the occasional sale of a product for a limited duration of a few days, varying depending on the products and specified on their sales page

 

3. PRODUCTS

The products offered for sale by ma-belle-equipe.fr on the Site (hereinafter referred to as the "Products") are described on the site. Each product will have an individual product sheet that presents at a minimum the essential characteristics of the product based on information provided by partners, suppliers, or manufacturers. The characteristics will have an indicative value. The products will also be presented with photos, which hold no contractual value. Ma Belle Equipe may also offer "Promotions": the products subject to these promotions (regarding price or any other characteristics such as delivery, quantity, etc.) will be sold for a limited duration and/or quantity.

 

4. ORDER PROCEDURES

Orders are exclusively placed online following these steps

-The Client fills their cart with Products

-The Client creates their account or logs into their account if they are already a member of ma-belle-equipe.fr

-The Client provides information regarding their delivery details.

-The Client is informed about the delivery method and the amount of delivery fees.

-The Client chooses their payment method.

-The Client confirms the General Conditions and their order.

-The Client is redirected to a page of our partner PayPal to complet their payment request.

- Finally, the Client receives a validation email for their order.

The Client is required to verify the completeness and accuracy of the information they provide to ma-belle-equipe.fr during the order process, particularly their delivery address. The validation email signifies acceptance by ma-belle-equipe.fr of the Client's order and thus forms the sales contract between the parties according to the provisions of the General Conditions. The information provided by the Client, along with the General Conditions, constitutes the contract concluded between the Client and ma-belle-equipe.fr, and will be reiterated in the order validation email. The Client is responsible for keeping this validation email, which represents their copy of the sales contract. Ma-belle-equipe.fr cannot be held responsible if this email is deleted by an "anti-SPAM" device. The Client can access the content of their order at any time by logging into the Site and opening the "My Account / My Orders" tab.

The General Conditions are accessible from any page of the Site.

 

5. AVAILABILITY

In the case of Classic Sales, the product offers are valid as long as they are visible on the Site. In the event of a product being unavailable after the order has been placed, the Client will be informed by email or phone about the delivery of a partial order or the cancellation of their order. In the case of a Flash Sale, Clients may order the Products on sale only during its sales duration and under the specific conditions indicated on the Site.

6. PRICES

The sale prices of the Products offered on the Site during Sales Sessions are indicated in Euros and include the applicable VAT rate on the day of the order.

Price to pay: The price to pay is the price indicated on the Site in the product sheet, plus any additional fees (notably delivery fees and service options) communicated at the time of the order. It may be reduced by a discount (e.g., promotional codes or vouchers). The price will only be final upon confirmation of the order. All prices are displayed on our Site in euros and include all taxes ("TTC").

Promotional codes or vouchers: The client may benefit from personal and non-transferable promotional codes or vouchers that can be used when confirming their order by entering their reference in the purchase form. It is specified that promotional codes or vouchers are only valid for the duration indicated by the company Ma Belle Equipe to the client.

Shipping fees: Shipping fees are applicable to each order placed. The exact amount of the shipping fees depends on the chosen delivery method, the delivery location of the order, and its content. The amount of delivery fees will be indicated in the cart and will be subject to the Client's approval before the cart is validated. To obtain an estimate, the Client can simulate their purchases on the Site. In any case, this indication remains an estimate, and only the price retained during the validation of the cart has contractual value, except in cases such as delivery difficulties or special delivery methods that may incur additional costs.

Discounts and VAT: Orders are payable immediately. No discounts will be applied. In the event of a change in the VAT rate, the price will be automatically adjusted without any notice other than the legal date of applicability of the new rate.

Price variations: The prices of the Products appearing on the Site are subject to change. Ma Belle Equipe reserves the right to modify prices without notice, especially in the case of labeling errors. Subject to the following, the prices appearing at the time of purchase are the prices applicable to that purchase. Although the website is developed with care, it is possible that the indicated prices contain errors. Ma Belle Equipe is in no way bound by its offer and reserves the right to cancel the Client's purchase when such an error occurs.

Foreign currencies: Prices are indicated in euros. If the payment currency differs from the currency in which the prices appear, the Client's bank will apply its exchange rate in effect on the date of purchase, which is beyond Ma Belle Equipe's control.

7. PAYMENT METHODS

Once the General Conditions are validated, the CLIENT proceeds to pay for their order, which can be done:

  • via PayPal

  • by credit card (for the entire territory) through a third-party provider ensuring the security of transactions. The CLIENT must have a debit or credit card such as Carte Bleue®, MasterCard®, VISA®, or American Express®.

The Client enters their details, validates the cart and the total price. They confirm their order by clicking on the "Payment" button and are then redirected to a page of our partner PayPal, where they provide their credit card information. Receipt of confirmation from ma-belle-equipe.fr validates the sale. The sale is then concluded under the suspensive condition of product availability and thus the receipt of confirmation sent by ma-belle-equipe.fr to the email address provided by the user during the purchase.

If the payment method selected by the Client fails, particularly due to insufficient bank account balance or incorrect bank details, the Client is responsible for all costs incurred by a third party's intervention to resolve the payment issue.

ma-belle-equipe.fr retains ownership of the goods sold until the delivery of the goods to the Client or to the recipient designated by the Client. Failure to make payment may result in the reclamation of the goods. These provisions do not prevent the transfer to the user, upon delivery, of the risks of loss and deterioration of the purchased goods as well as any damages they may cause.

8. PAYMENT SECURITY

ma-belle-equipe.fr has chosen effective and rigorous tools for securing payment methods. ma-belle-equipe.fr has adopted a PayPal solution that uses SSL (Secure Socket Layer) encryption, one of the most effective security systems currently available, which establishes an encrypted connection directly between the Client and the bank.

PayPal is also PCI DSS certified by Visa & Mastercard, ensuring a high level of security for payment methods.

Ma Belle Equipe does not have access to the confidential information regarding the payment method that the Client uses during payment. Therefore, the Client's banking details will be requested for each new order. In fact, only PayPal has access to the confidential information, which remains inaccessible to third parties.

Although Ma Belle Equipe uses encrypted security software, the security of information and payments transmitted over the Internet or via email cannot be guaranteed. Ma Belle Equipe cannot be held responsible for damages resulting from the use of electronic communication methods, including—but not limited to—damages resulting from failures or delays in the transmission of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications, and for the transmission of viruses.

9. DELIVERY

9.1 Delivery Methods:
The shipment of Products takes place in the Territory defined in these General Conditions. Delivery will be carried out by a courier selected by Ma Belle Equipe (GLS, Colissimo, or Mondial Relay), depending on the weight and dimensions of the package. The delivery of each product in the cart may be made independently. The Client must carefully fill in all fields of the delivery form at the time of ordering, including their delivery details and provide a landline or mobile phone number. Neither Ma Belle Equipe nor the transport company can be held responsible for an inability to deliver due to inaccuracies or errors in the delivery address.

9.2 Delivery Times:
The delivery times indicated during the order confirmation are calculated in business days and are specific to each Product. Due to the variety of supply areas, manufacturing and logistical constraints, and the “made-to-order” nature of certain products, these times may vary, and Ma Belle Equipe cannot be held responsible for this. In any case, the delivery time for Products will not exceed twenty (20) weeks from the Client's receipt of confirmation of their order.

9.3 Additional Fees:
In the event of an inability to deliver on the scheduled day due to inappropriate information, accessibility difficulties, or unreported passage issues by the Client, or if the Client is absent from the appointment in violation of commitments made during contact, additional delivery fees may be charged by Ma Belle Equipe. The company will contact the Client for payment of these new delivery fees before any further delivery of the Product. In case of non-payment of these fees, Ma Belle Equipe reserves the right not to proceed with the delivery of the Product. The risks of damage resulting from these constraints will also be borne by the Client.

9.4 Postponement of Delivery Date/Change of Delivery Location:
If the Client wishes to change the delivery address or postpone the delivery date, they must inform Ma Belle Equipe as soon as possible and no later than five (5) business days before the scheduled delivery date. To inform Ma Belle Equipe, the Client should use the “Contact” section available on the Site or in their “My Account” area. They should reference their order number, the Product in question, and provide comments justifying the modifications. Ma Belle Equipe will then confirm its acceptance or reasoned refusal via email or phone as soon as possible.

9.5 Receipt of Ordered Products:
Upon delivery, the Client must unpack the Product in the presence of the Courier/Messenger and check that the delivered Product matches their order and that no damage affects the Product before signing the delivery note. In case of any discrepancies, the Client must precisely note the nature of their reservations on the delivery note. These reservations must be handwritten, dated, detailed, and signed on the delivery note. For example, stating "damaged product" is not sufficiently explicit. The Client must specify the nature of the damage: scratches, dents, stains, etc. Similarly, if a delivery error is noticed, the Client must specify the nature of the error: wrong color, damaged leather, incorrect reference, etc.

In the case of an error or damage, the Client must refuse the Product and send their reservations within five (5) days via email through the “Contact” section of the Site and simultaneously by registered letter with acknowledgment of receipt to the address provided by the Ma Belle Equipe customer service. Any claim made beyond these deadlines cannot be accepted. If the Client does not raise any reservations, the delivered Product is deemed satisfactory and cannot be subject to any further disputes. For instance, the Client cannot raise objections either to Ma Belle Equipe or to the Courier/Messenger after the departure of the Courier/Messenger, even if the package has not been opened in their presence.

Except in cases of non-compliance or hidden defects, no subsequent claim and/or reservation will be accepted by Ma Belle Equipe after the Client has received the Products if they have not complied with the procedure described above.

 

10. CANCELLATION
The Client has the option to cancel any order for products without charge and without stating a reason, provided that it has not yet been shipped. To request an order cancellation, the Client should contact Ma Belle Equipe via email through the “Contact” section of the Site or by phone at the indicated number. If Alaskan MAKER can fulfill the client's request, a confirmation email will be sent, and the Client will be fully reimbursed. If the products ordered by the Client have left the FactoryChic warehouse in France and have been taken over by a carrier, it is still possible to cancel the order; however, in this case, the refund will be reduced by the delivery costs incurred. The products will be delivered, and the Client must refuse them upon receipt. The products will be returned to Ma Belle Equipe, and the order amount will be fully refunded to the Client, except for the delivery charges.


11. RETRACTION

11.1 Non-Customized Products
The Client has fifteen (15) days from receipt to return their order at their expense, regardless of the reason. If the deadline falls on a Saturday, Sunday, or public holiday, the period is extended until the first business day following at midnight. To facilitate the processing of the Client's retraction request, they may send such a request to Ma Belle Equipe through the “Contact” section available on the Site or in their “My Account” area. The retraction request submitted ends the fifteen (15) day countdown that runs from the receipt of the products. The Client may also inform Ma Belle Equipe by sending a letter to the address provided by the Ma Belle Equipe customer service or by calling Customer Service at 03 20 27 38 90 (local call rate, Monday to Friday 10 am-12 pm and 2:30 pm-8 pm).

In the event of exercising the right of retraction, Ma Belle Equipe will refund the Buyer the total amounts paid as soon as possible and no later than thirty (30) days from the receipt by the Seller of the returned product. The refund will be made by bank transfer or, with the Buyer's agreement, in the form of vouchers for a product worth less than 500 euros. The basis for the refund covers the total amounts paid. However, the return shipping costs of the product are the sole responsibility of the Buyer.

The Seller may also offer a product of equivalent quality and price. Products must be returned by post or by a carrier in their original condition and complete with their original packaging, including a copy of the invoice and properly stamped. Incomplete, damaged, or used products by the Buyer, or those that have been subject to abnormal usage, will not be accepted.

Ma Belle Equipe will carry out a quality control check of the product at the warehouse. Products must be in new condition, returned in their original packaging, with no signs of use, and accompanied by their accessories and any instruction or assembly manuals. Only after verifying that these conditions are met will Ma Belle Equipe proceed with the refund of the amounts received for the returned products. If the mentioned conditions are not met, the Client’s refund will be reduced by the amount corresponding to the loss of value of the product, as determined during the inspection.

To ensure the product's return and receipt in the best conditions and to protect against any risk of loss or damage, it is recommended that the Buyer contact the Seller at customer service at 03 66 73 25 29 (local call rate, Monday to Friday 10 am-12 pm and 2:30 pm-8 pm) before returning the product. A return number will be assigned to the product and communicated to the Buyer, along with all useful information on the procedure for optimal management of returns.

In the case of abnormal or abusive returns, Ma Belle Equipe reserves the right to refuse a subsequent order. Throughout the procedure, the Client will be informed by email of the receipt of their retraction request, the return of their package, as well as the date of the refund.

11.2 Customized Products
We draw the attention of internet users to the fact that the right of retraction described above does not apply to items that have been personalized. As indicated in the Consumer Code Article L121-20-2: "The right of retraction cannot be exercised unless otherwise agreed by the parties, for contracts providing for the supply of goods made to the consumer's specifications or clearly personalized or which, due to their nature, cannot be returned (...)"

The client is therefore 100% responsible for the creation they validate at the time of the order. Nevertheless,

  • If the client wishes to redo their customizable product due to an error for which Ma Belle Equipe is not responsible (spelling mistakes, wrong size ordered, etc.), Ma Belle Equipe grants an exceptional 50% discount for reordering the same product with the same design and correcting the error made by the client.

  • If the client wishes to return their customizable product, they will need to return the product at their own expense, and Ma Belle Equipe will exceptionally refund the client an amount equivalent to 50% of the total amounts paid (as soon as possible and no later than thirty (30) days from the receipt by the Seller of the returned product). The refund will be made directly by bank transfer to the account used for the transaction, or via PayPal, or by check, or with the Buyer’s agreement in the form of vouchers. The basis for the refund covers the total amounts paid (Product + delivery costs), but the return shipping costs are entirely the responsibility of the Buyer.

 

12. WARRANTY
The Client may inform Ma Belle Equipe of any non-conformity of the Product with their order after receiving the Product. To do this, the Client can use the “Contact” section of the Site. There, they should describe the non-conformity of the delivered Products and their choice between exchange and refund. If the originally ordered Product is no longer available, the client may request a replacement with an equivalent Product or a refund. Ma Belle Equipe will outline the procedure to follow for the free return of the Products before receiving the new product or refund. However, Ma Belle Equipe reserves the right to refuse any exchange if it would incur disproportionate costs and to opt for a refund instead.
This procedure cannot be used within the framework of exercising the right of retraction, in which case the return shipping costs of the Product are entirely the Client's responsibility.

REPAIR
The Products are guaranteed by Ma Belle Equipe for one (1) year from the receipt of the Product by the Client if a defect of conformity is found in the Products. The Client must contact Ma Belle Equipe via email through the “Contact” section of the Site. They must also send their request to Ma Belle Equipe by registered mail with acknowledgment of receipt to the address mentioned in the “Retractation” article.
Before agreeing to take care of the Product under warranty, Ma Belle Equipe will verify that:

  • The Product is identical to the Product that was sent to the Client, without any damage or specific modifications.

  • The defect reported by the Client is not the result of:

    • abnormal use of the Product;

    • normal wear and tear or aging of the Product;

    • an accidental event possibly caused by the Client or a third party.

Moreover, the shipping and return costs of the Products will be entirely borne by the Client.
If the above conditions are met, Ma Belle Equipe commits to repairing the Product. If repair is not possible, Ma Belle Equipe will offer the Client to replace their Product with an equivalent product or to refund them with a voucher corresponding to the value of their initial purchase.

HIDDEN DEFECTS
Ma Belle Equipe guarantees the Client against all consequences of hidden defects that may affect the sold Products, except as otherwise stipulated on the Site in accordance with French law.
The warranty for hidden defects only applies if the client proves that the defect they noted existed before Ma Belle Equipe delivered their product. It is the client’s responsibility to have the product examined at their own expense to obtain proof of the existence of the hidden defect.
Ma Belle Equipe's liability can never exceed the value of the item in question. Furthermore, no other compensation may be claimed by the client other than those expressly provided for by the Consumer Code.


13. INTELLECTUAL PROPERTY
Ma Belle Equipe is a protected trademark registered with the INPI (National Institute of Industrial Property).
The website www.ma-belle-equipe.fr is the exclusive property of Ma Belle Equipe and cannot be used without our prior agreement.
The graphical and editorial elements presented on the Site are the property of Ma Belle Equipe and protected under copyright law. The presentation of the products (photographs, videos, drawings, product sheets, etc.), whether for sale or not, is also the property of Ma Belle Equipe or its partners and therefore cannot be reproduced without the express permission of their respective owners. Any copying or reproduction, any use of all or part of our graphical and/or editorial elements, or any presentation of our products is strictly prohibited and constitutes an infringement of our intellectual property rights, which will be pursued and punished as such. However, hypertext links to the site are permitted without specific requests.

14. COOKIES
To better serve Users and Buyers, the Seller measures the number of pages viewed, the number of visits, as well as activity on the Site and the frequency of return visits.
To this end, the Seller uses "cookies" technology. These cookies store information related to the navigation of Users and Buyers on the Site (the pages viewed, the date and time of viewing, etc.).
The Seller can read this information during subsequent visits. These cookies do not allow the Seller to identify Users and Buyers. The Client can oppose the recording of cookies by setting their browser as follows:

15. CONFIDENTIALITY
The website ma-belle-equipe.fr has been declared to the CNIL (French Data Protection Authority) on April 19, 2017, under registration number 2056997.
In accordance with Law No. 78-17 of January 6, 1978, it is reiterated that the personal data requested from the buyer are necessary for processing their order.
Ma Belle Equipe commits to using the confidential information of its users only within the scope of operating its Site.
Upon the first request from a user wishing to be removed from the Ma Belle Equipe database, we commit to disabling all contact details and information related to the concerned member.
Ma Belle Equipe may apply technical means to obtain non-personal information about users to improve site functionality, such as tracking the number of visitors to the site.
Moreover, Ma Belle Equipe only collects personal data such as name, first name, address, and email address if these are voluntarily provided by the visitor. The data collected cannot be used for any commercial purposes other than those indicated on the site or that may be developed later by Ma Belle Equipe.
None of the information can be transferred to third parties without the express consent of the member during their registration or subsequently in their data management space. Each member has the right to access, modify, rectify, or delete their data (Article 34 of the Computer and Freedom Law). To exercise this right, they should contact Ma Belle Equipe by sending an email to celine@alaskanmaker.fr or, at any time, by modifying their data in “My Account.”

16. RECOMMEND YOUR PURCHASES AND SAVE WITH THE JITIPS SERVICE
Jitips is a peer-to-peer purchase recommendation service that generates savings.
The Jitips service is available on a selection of products from the Ma Belle Equipe website.
Ma Belle Equipe reserves the right to modify this list at any time.
The Jitips service is activated by default on eligible products. The client can deactivate the Jitips service before confirming their order.

  • When the Jitips button is blue, the Jitips service is activated.

  • When the Jitips button is gray, the Jitips service is deactivated.
    Purchasing a product with the Jitips service activated creates a jitips. A jitips is defined by an HTTP link, a duration, and a reduction evolution table. This information is available on the Ma Belle Equipe website by clicking on the HTTP link of the jitips sent by email to clients participating in a jitips. Ma Belle Equipe reserves the right to modify the duration of a jitips and the reduction table at any time.
    The amount of the reduction increases with each buyer of the same product who clicks on the same Jitips link. The reduction is refunded to each buyer via the payment method they used within 14 days following the closure of the jitips.
    By purchasing a product with the Jitips service activated, the client agrees to share their contact and order information with the Jitips company and unreservedly accepts the general terms of use of the Jitips service available at the following address: www.jitips.com/cgu.


17. DISPUTES AND RESPONSIBILITIES
The Client is required to verify the completeness and accuracy of the information provided to Ma Belle Equipe during the order process, particularly the delivery address. Ma Belle Equipe cannot be held responsible for any typing errors that could lead to delivery mistakes. Ma Belle Equipe also cannot be held responsible for the Client’s failure to comply with the delivery terms and the appointment they themselves set with the carrier. In such cases, the costs necessary for reshipping and storing the products will be the Client’s responsibility.
Without limiting the above paragraphs, Ma Belle Equipe's liability cannot exceed an amount equal to the sums paid or payable in the transaction that gave rise to the liability, regardless of the cause or form of the action concerned. Events considered as force majeure or fortuitous cases exempting liability include all facts or circumstances that are irresistible, unpredictable, and independent of the parties' will, particularly in the event of a total or partial strike by carriers, riots, war, and natural disasters.
The Client is solely responsible for their choice and purchase of goods. Therefore, the total or partial inability to use the Products, particularly due to hardware incompatibility, cannot give rise to any compensation, reimbursement, or liability on the part of Ma Belle Equipe, except in the case of proven hidden defects, non-compliance, defects, or the exercise of the right of withdrawal as provided by the French Consumer Code.

18. DISPUTE RESOLUTION
The General Terms and Conditions will be executed and interpreted in accordance with French law. The parties will seek an amicable agreement before any litigation, it being noted that this does not interrupt the deadlines for exercising warranty rights. Any dispute of any nature or any dispute relating to the formation or execution of the order, even in the case of recourse to warranty or multiple defendants, shall, in the absence of an amicable agreement, fall under the exclusive jurisdiction of the courts within the jurisdiction of which the registered office of Ma Belle Equipe is located. The jurisdiction of the courts will comply with the rules of the Civil Procedure Code when the buyer is not a professional.


19. LANGUAGE
The General Terms and Conditions, the orders, correspondence emails, and the sales contract concluded with the Client are in French for the Territory.


20. DIVISIBILITY OF CLAUSES
If for any reason one (or more) of the clauses of these General Terms and Conditions of Sale is declared null, unenforceable, void, illegal, or non-applicable due to a law, regulation, or as a result of a final decision by a competent court, this modification shall not affect the validity, legality, or applicability of the other provisions of these General Terms and Conditions and shall not exempt the user from fulfilling their contractual obligations.

21. UPDATE

The date of the update of these general conditions is April 19, 2017.
